Mediation allows for mutually agreed upon resolution of disputes, thanks to intervention by a third party known as the mediator.

Recourse to a mediator is specifically addressed by the law pertaining to moral harassment.

The person who believes he/she is the victim of harassment or the person against whom an allegation is made may both appeal to mediation.


Advantages:

  • Mediation helps reestablish dialog with the mediator acting as intermediary,
  • It allows for ending conflict in a way that does not lead to defeat of one of the parties before a tribunal,
  • It adopts an approach that is oriented toward finding a solution in the face of divergence, before it becomes an insurmountable difference.
